Why Instant Justice is not possible in India - Circumstances ?
Instant Justice is not possible in India. In India, there will be a politician behind 75% registered criminal cases and 65% behind in civil litigation . That means from the date of lodging report to registration of Criminal case, a local politician will play vital role.
Not behind back every crime or every litigation there will be a politician, but they will play a vital role behind back every crime registered by police.
If you are not supporting a candidate contesting in elections in your constituency and whereas you disclosed the same in public or if you canvas on behalf of your favourite politician else you did not supported the candidate and when it is transparent, in India, that s the enough reason to send you behind bars. That may be foisting false cases or making you to not meet the ends of justice, what ever it may be the ultimate weapon in the hands of Politicians in India are Executive officials who work under Government.
In such a situation the only hope in India is Judiciary the third estate an autonomous body to protect the Individual rights / group of people rights . So while deciding a case the courts examine the circumstances, Evidence on record and finally comes to a conclusion. An elaborate trail is a fact finder.
So here many peoples inner question is that "why not instant justice?"
A hurry bury trail is always a half cooked food. Even the rape cases are being foisted in India by utilising section 376 of IPC with honey trap. Some of the politicians for the purpose of their political advantage utilising section 376 IPC as tool to grab money, power lobbying etc..., and some persons utilising section 376 as money extraction. That doesn't mean that all rape cases are foisted but the rape cases which were coated with political glamour are being elevated and focused, promoted, advertised in society.
When a criminal case is foisted against innocent a hurry bury "instant justice"will carry injustice to that innocent. As such that innocent may be you or some other person who belongs to you. So due to several practical political issues and other problems "Instant Justice"is a threat to Democratic Country, Especially in India.
